Our responsibility to you
When you create an account to access the app, you will be asked to confirm whether you agree to these terms. If you do not agree to these terms, you should not confirm that you agree to them and you should delete the app from your device.
You should also read our Privacy Policy which, while not part of the contract between us, includes important information about the data, including personal data, that we collect from and about you when you use the App.

Apple® and Google™ terms also apply
Your use of the App may also be subject to the rules and policies of the Apple® App Store® and the Google Play™ Store, depending on the type of device on which you have installed the App. If there is a difference between those rules and policies and these Terms, these rules and policies will apply instead.
Changes to these Terms
We may make minor changes to these Terms without notice to you, so long as those changes do not materially affect your rights. If we make changes to these Terms that may materially affect your rights, we will attempt to notify you reasonably in advance by e-mail or by drawing your attention to such changes in the Application.
If you do not agree to such changes, you should not confirm your agreement and should delete the Application and your account.
This does not affect your legal rights as a consumer under the rules and policies of the Apple® App Store® and Google Play™ Store.
Changes to the application
We may make changes to the App at any time to add features or improve performance, reflect changes to your device's operating system, address security issues, or comply with any applicable laws or regulations.
If you choose not to install updates, you may not be able to continue using the App or the App may not function as it should.
Use of the Application by Children
Due to the mature nature of the content, we do not direct the app to children and we do not knowingly collect personal data on children. For this purpose, a "child" is defined as any person under the age of 18 or who has reached the age of majority at the location where our website or app is accessed.
We have assigned an age classification of 17+ to our app in the Apple® App Store®. This is equivalent to an ESRB "Mature" and PEGI 16+ rating.

In addition, we've added a requirement that your child's date of birth be entered before accessing any of our content. This verification allows us to block minors from accessing the application.
If you have parental responsibility for a child under the age of 18 and are concerned that we have collected personal information about your child, please contact us at contact@melba.app.
Your access to the application
We personally give you the right to use the App. You may not transfer the App, including your subscription to the App, to another person. If you sell a device on which the App has been installed, you must remove the App from the device.
If you install the App on a device that you do not own, you must have the permission of the device owner to do so. You will be responsible for complying with these conditions whether or not you own the device.
Your account
If you choose or are provided with a username, verification code or other piece of information as part of our security procedures, you must treat this information as confidential and not disclose it to any other person.
We reserve the right to deactivate your account at any time if you have informed us, or if we have reason to believe, that your account has been compromised in any way.
Your Health and Safety When Using the Application
The Application is provided for informational purposes only. At the time of writing these terms and conditions, it does not create any relationship between a doctor or therapist and a patient. If you are concerned that using the app may pose a risk to your mental or physical health and safety, you should seek professional or specialist advice before using the app.
While we only work with reputable and experienced therapists to develop the content available through the App, we make no representations or warranties, nor do we make any guarantees, that the App will benefit you or be tailored to your particular needs.
Your use of the App
You may use the App only for private, non-commercial purposes.
You agree that, unless permitted by the laws of the country or territory in which you reside, you may not:
- rent, lease, sublicense, provide or otherwise make available the Application to any person,
- copy the Application, except in the normal course of using the Application
translate or modify the Application, or allow the Application to be combined or incorporated into other programs.
